In this Florida case, the appellant is challenging a final judgment of dissolution of marriage entered against him. Regarding animal law, the woman filed an appeal against the trial court’s decision to distribute the family dogs, Liberty and Nico, to the former husband.

  • The former wife testified that the family got Liberty “to serve as an emotional support dog” and that she was her daily company when she was married to another man.

(1) Whether the trial court erred in appointing Kyle Held as an expert witness in the field of animal cruelty and dog fighting; (2) whether the State presented sufficient evidence to convict Queen of dog fighting; and (3) whether the trial court erred in denying Queen’s motion to recuse herself from the case in question.

  1. Furthermore, according to Held’s evidence, he had examined dog fighting enterprises “probably hundreds” of times before becoming accredited by the National Animal Control Association.

Burkholder, doing business as Whispering Spring Kennel in Pennsylvania, petitioned for review of an adjudication of the Secretary of Agriculture (Secretary) that imposed a $19,500 civil penalty on Burkholder for transferring two dogs in excess of the annual limit under his Class IV kennel license in December of 2017.

Burkholder makes two points: first, he claims that First, the Dog Law does not specifically state that transfers of more than 60 dogs by a private kennel constitute infractions; second, the punishment imposed is exorbitant and arbitrary; and third, the penalty imposed is unjustified.

The court first considered the distinction between separate and continuous infractions of the Dog Law, because it was a first-of-its-kind question under the Dog Law.

The issue here is that, in the event that an owner transfers more canines than his license permits, there is no means to fix the infraction.

Each improper transfer of a single dog is a single breach of the Dog Law and not a continuing infringement since it is not continuous in character and because such transfers may be reasonably split into discrete offenses in order to apply separate fines,” the court wrote.

Because the Department of Justice imposed continuous penalties for two separate unlawful transfers, the court determined that the Department committed an error of law. After additional consideration, the case was remanded. Documentation on a case
